Kuwait Cassation Court Eliminates Limit on Disability Housing Grants per Family

Kuwait’s Court of Cassation settled a dispute by determining that the Kuwait Credit Bank must pay the 10,000-dinar housing grant to a person with disabilities even after similar grants had gone to other family members sharing the same residence. The court stressed in its reasoning that Law No. 8 of 2010 contains no ceiling on the number of eligible recipients inside a single home. A prior restriction limiting payments to two children per family, which had appeared in a 2014 cabinet decision, no longer applies and cannot continue without fresh legislative grounding, according to the ruling.

The Public Authority for Disability Affairs coordinates implementation of the grant alongside the bank under the terms of the 2010 law, which provides the extra sum on top of standard housing loans to cover specialized construction needs. Court of Cassation judges noted that the legislative text remains general and absolute, meaning it must be applied without artificial narrowing to only two beneficiaries. This interpretation follows the cancellation of the limiting clause in Cabinet Decision 320 of 2014, the court assessment found.

In the case before the court, the bank had declined to release the grant to one son on grounds that payments had already gone to others in the household. The Court of Cassation overturned the lower court’s judgment and directed the bank to proceed with the disbursement. The decision aligns with provisions that extend the benefit whenever qualifying conditions for housing welfare are met, regardless of how many family members have previously drawn it.

Lawyer Ali Al-Duwaikh welcomed the verdict as a decisive and equitable step that upholds the rights of persons with disabilities by removing arbitrary numerical barriers. He indicated that the precedent should ease access for many additional families in similar situations. Reports in Al-Seyassah and Al-Rai detailed the court’s emphasis on applying the law in its unrestricted form following the earlier regulatory change.

Public Authority for Disability Affairs figures show 68,738 registered cases of disability across Kuwait as of September 29, 2026, with intellectual disabilities accounting for the largest share at 18,990 followed by motor disabilities at 14,676. The authority’s data also lists 11,823 physical cases, 8,006 learning disabilities and smaller numbers in visual, hearing and other categories. These totals underscore the potential reach of the housing grant reform among Kuwaiti families that include multiple members with qualifying conditions.

Under the framework established by Law No. 8 of 2010, persons with severe or moderate disabilities receive the 10,000-dinar supplement while those with mild disabilities qualify for 5,000 dinars, both intended to adapt homes to specific accessibility requirements. The Court of Cassation reiterated that the law grants this support without reference to a family cap once housing welfare eligibility is confirmed. The ruling arrives as the authority continues broader efforts to streamline services and expand employment opportunities for registered individuals, with recent statistics indicating more than 7,800 persons with disabilities working in government and private sectors.
