A Kuwaiti Court of Appeal upheld Kuwait Airways’ decision to terminate travel privileges for retired staff on Tuesday, the Arab Times reported. The ruling ends a dispute over benefits the airline said were unsustainable. Former employees had argued the complimentary flights were part of their retirement rights.
The Court of Appeal determined that the travel perks were not a contractual entitlement but a discretionary benefit the carrier could withdraw. Arab Times reported that the lower court ruling in favor of the retirees was overturned on appeal. Kuwait Airways had argued that continuing the scheme imposed a prohibitive cost.
The decision forms part of larger cost-cutting efforts at the airline. AeroTime reported in August 2024 that Kuwait Airways terminated contracts of expatriate employees and retirement-age staff to promote national employment and lower expenses. World Bank data places the retirement age in Kuwait at 50 for many roles, contributing to a sizable pool of former airline workers.
Arab Times said the retirees claimed the privileges dated back decades and were integral to their employment terms with the national carrier. However, the appeals court sided with the airline’s position that such benefits could be altered without violating any legal obligations. The ruling is considered final.
Kuwait Airways has faced financial challenges in recent years, including major losses during the COVID-19 pandemic that prompted earlier staff reductions. In 2020, the carrier laid off 1,500 foreign workers, according to multiple aviation industry reports. The transformation plan includes modernizing operations and focusing on local talent.
In a related move, Kuwait Airways announced in September 2025 special fare discounts for retirees, providing 20 percent reductions for retired passengers and 15 percent for one companion. Kuwait Times reported that the offers apply to all routes and classes during specified booking and travel periods. Chairman Captain Abdulmohsen Salem Al-Fagaan highlighted the initiative as support for the retired community.
The case may have implications for benefit structures across other Kuwaiti institutions. Public sector reforms have increasingly scrutinized post-retirement perks to ensure fiscal responsibility.
