The Ministry of Health published Ministerial Decision No. 351 of 2026 in the official gazette Kuwait Today, establishing a framework of fees for services from the Medical Liability Department. The decree sets the charge at KD 200 for each request to constitute an objection panel against findings from technical committees. Health Minister Dr. Ahmad Al-Awadi signed the decision, which also levies KD 20 per application for administrative services tied to medical practitioners and health establishments, the document shows.
Administrative fees for health license management services will similarly stand at KD 20, according to the ministerial decision. The same amount will apply to requests for additional copies of technical committee reports. The Medical Liability Department, created under Law No. 70 of 2020 as an independent body to issue expert opinions on medical errors and professional violations, will apply these charges uniformly once they enter force.
Objectors must pay the KD 200 fee within 30 days of receiving notification that their challenge has been accepted, the decree stated. Failure to meet the deadline will result in the objection request being treated as if it had never been submitted. The timeline and payment rules form part of a broader effort to streamline procedures at the department, whose reports carry significant weight in related legal proceedings.
The decision cancels any prior rules that conflict with its provisions and takes effect from November 1, 2026, the Ministry of Health confirmed in the published text. It rests on approvals from the Council of Ministers regarding the fee schedule proposed by the department’s leadership. Public interest requirements drove the issuance, according to the decree’s preamble.
Under existing procedures, parties have 15 days from notification to lodge written objections with specific reasons if they believe a report overlooked key evidence or contained contradictions, the department’s operational guidelines indicated. The new fees introduce a financial threshold to such appeals while preserving the 30-day payment window once an objection is deemed admissible. The department remains the sole entity empowered to deliver binding technical assessments in medical liability cases across Kuwait.
Implementation of the fee structure coincides with ongoing efforts to strengthen regulatory oversight in the health sector, where the department handles complaints, official reports and court referrals involving potential errors or misconduct. The Ministry of Health has directed all relevant entities to adhere to the updated rules without exception once the November start date arrives.
