The Misdemeanor Court accepted defense arguments that police arrest and search procedures failed to meet legal requirements since the defendant was located inside a private hotel space rather than a public area, according to case records. Attorney Walid Masoud demonstrated the procedural shortcomings, leading the court to deem any gathered evidence inadmissible. Hotel security personnel had initially alerted authorities to a reported fight and property damage at the site, which brought officers to the scene where the man was found in an abnormal condition.

Kuwait enforces stringent laws against alcohol consumption and public intoxication, with violations often resulting in misdemeanor prosecutions by local courts. The Interior Ministry has pursued multiple campaigns targeting illicit alcohol networks in recent years. A ministry statement from August 2025 detailed the arrest of 67 suspects linked to toxic homemade liquor that caused 23 deaths and over 160 poisoning cases nationwide.

Case documents indicate the original complaint centered on the defendant disturbing others while intoxicated, yet the court focused on the validity of the initial police action. The ruling turned on the classification of a hotel room or villa as a closed environment rather than an open public venue accessible to all. This determination nullified the charges without reaching the underlying allegations of nuisance behavior.

Similar legal distinctions appear in other jurisdictions, where courts have ruled that intoxication inside a rented hotel space does not meet public place criteria for conviction. The Kuwaiti decision reflects careful application of procedural safeguards in misdemeanor matters before the lower courts. Public Prosecution officials had pursued the case based on the hotel security report and police observations at the time.

Attorney Masoud’s submissions emphasized that law enforcement must adhere strictly to definitions of public space when initiating such arrests to protect individual rights. The court issued its acquittal following review of the full file, closing the matter without imposing any penalties or further restrictions. Authorities have not indicated plans to appeal the outcome as of Sunday.
